Legal
Premier League Champs v. Premier League

@TheTimes

🧑‍⚖️💼 Talk about a sore winner, Manchester City have launched a full legal assault against the Premier League, with the four-in-a-row champions challenging everything from sponsorship rules to the means by which decisions are taken by the competition. Seems as though winning a historic 4 consecutive Premier League wasn't enough, City are now looking to sue the Premie League with hopes of revamping rules centre around clubs’ transaction-sponsorship deals. City are challenging the Premier League's Associated Party Transaction rules (APT) claiming they are unlawful. A private arbitration hearing is scheduled to begin next week.

  • City have accused the Premier League of "discrimination against Gulf ownership" and are also suing for damages, according to a report first published by The Times.

  • City have been owned by the Abu Dhabi United Group since 2008.

  • Pep Guardiola's team has been crowned champions of the Premier League in six of the past seven seasons.

  • Last month City became the first club in English football history to win the league title in four consecutive seasons

👀🤝 R u down w the APT? , With Premier League clubs set to meet for their AGM on Thursday, probably best we introduce you to APT and their rules. City’s league challenges centre on associated party transaction rules.

  • APTs, in which clubs strike sponsorship or revenue deals with businesses linked to their owners, have been the subject of scrutiny from the league for some time.

  • In February clubs voted to approve tougher rules regarding how such apt deals are valued, a requirement to assess fair market value for APTs has been challenged by City, who have argued it contravenes competition law.

  • City are asking for financial damages for losses perceived from sponsorship deals that were halted by the newly voted rules;

  • City further claims that the Premier League has not been able to prove that clubs such as them get an unfair advantage from APTs.

  • City are also taking aim at the league’s voting rules; the requirement that 14 out of 20 clubs must vote in favor of any proposal prior to its adoption.

  • within an 165-page legal document City argue that they are the victims of “discrimination”, describing rules they say have been approved by their rivals to stifle their success on the pitch as a “tyranny of the majority”.

  • The takeover of Newcastle United by Saudi Arabia’s sovereign wealth fund in 2021 had previously occasioned hurried attempts by clubs to change APT rules.

1️⃣1️⃣5️⃣ Charges within 4 Years, City have been hit with 115 charges in February 2023 following a four-year investigation. The club have launched their legal action as they prepare to defend themselves against allegations that they have breached Premier League financial rules. The hearing is set to start in November and, if found guilty, City could face punishments including a fine, points deduction or expulsion from the Premier League.

  • A Premier League disciplinary commission will hear over 100 charges against City for allegedly breaching its financial regulations.

  • Some of those charges relates to amounts paid to City by sponsors linked to Abu Dhabi.

  • Man City, who have deals in place with Etihad Airways, argue that sponsors should have the freedom to decide how much they want to pay rather than have a figure independently verified as offering fair market value.
